2500 people will soon be employed for the construction of the KwaDukuza Shopping Mall that will be developed by businessman, Vivian Reddy's Double Ring Trading, who have recently won a High Court battle. The Durban High Court has dismissed with costs, the application of Cassim Mohammed Moola, The Concerned Citizens Group, CCG and Devadas Paul David of KwaDukuza, who applied for an urgent interdict to stop the construction of the KwaDukuza Mall and Mixed Use Development being developed by Double Ring Trading. Vivian Reddy found that the application was frivolous and vexatious and that the litigant had acted from improper motives.

Vivian Reddy said that, "this captured group is really a proxy for a few local business persons that do not want competition in the town of KwaDukuza. Their frivolous objections have prevented and delayed the execution of the project. We have incurred major costs from the delays and more importantly over 2500 people were denied employment opportunities, as this mall could have been completed 12 months ago. Through the various delaying tactics they have held up this project for over one year. It is my intention to sue for damages totaling R10million including legal costs. As per the judge's order, I will be suing them jointly and severally."

The court found that the application was misguided, veering the contention Double Ring Trading was the beneficiary of an unsolicited bid for public property to an attack on the provisions of the sale agreement. "Despite the applicants making repeated reference to an "unsolicited bid" on the part of Double Ring Trading. I find much difficulty in appreciating how such a bid would form part of the overall development scheme where it is not denied that there was a public invitation to tender, which a number of bidders responded to", said Durban High Court Judge Mahendra Chetty.
