The Pietermaritzburg High Court has dismissed a civil claim of R13 million brought against the eThekwini Municipality, ruling that Durban Metro Police acted lawfully and within their mandate during the height of the COVID-19 pandemic.
The case arose from the arrest of a Durban man during South Africa's Level 4 lockdown in 2020, when stringent restrictions on movement were in force. The individual had been detained and charged for failing to comply with lockdown regulations - charges that ultimately led to the civil damages claim.
In its judgment, the Court found that the Metro Police officers had conducted themselves in a manner that was both lawful and procedurally correct. As a result, the Municipality was absolved of any liability in the matter.
